tmobile warranty? help?

So i had a mytouch 4g which got lost. Luckily i had warranty on it. I know that i would have about $130 to get a new phone. But my question is would tmobile allow me to pick the Galaxy S 4g?. Since it is equal or lower value than the mytouch 4g. And also will it be new or rerefushied
