thinking about ordering a gsm unlocked phone for at&t would this work?

i was looking on amazon and found quite a few phones i want they are gsm unlocked phones one in particular was the htc wildfire, i was wondering if this would work with at&t right out of the box and would at&t know that its a smart phone and charge me the caped data price or not even know about it?

any info on this would help. i really need a new phone and this seems to be the best way to go
