There was a tree that fell on my sisters car in the state of new jersey. There was no storm prior to the date that the damage was caused. We have substantial evidence and satellite pictures showing how big and obscene the tree is. The tree extends over property lines and into the street. We have pictures showing how the tree has decay on the limb that caused the damage. The neighbors insurance company is claiming because the neighbors did not know of the decay the insurance company isnt liable for the damage. The insurance company came out 10 days later to assess the damage and the tree was already cut down by then by the neighbors. They did not get a statement from our party and we are extremely upset at this point. We do not have comprehensive coverage for my sister vehicle due to the age of the car. We are ultimately going to have to take them to court. Do we have a valid case?
