the double tap home feature on my ipod touch is not working?

okay, so it will work. but only if i have music playing. if i pause the song, then the home controls for the ipod won't show up when i double click home.
 
That's strange. It does that on the iPhone, but shouldn't on the iPod touch. Unless the newest firmware changed that.

But I really wish Apple would implement that feature into the iPhone. I hate having to jailbreak and install iPod Pop to get a feature the touch has.
