Telus lost my phone so do I get a new one?

I sent my phone in to be fixed and after 6 weeks they admit they have no idea where my phone is or where it might be so does that mean I need to get a new phone

since I'm in a 3 year contract would I likely have to get the same phone because of the problems with the first one I'm unsure of wanting that phone again
