Take the landlord to court b/c they won't return my S.D.?

This was an oral agreement between the landlord and I. A receipt was given to me for the security deposit. It's a receipt w/ no other details stating my tenant rights, like a flimsy little paper. My problem is they cashed my deposit three days before I'm about to move in. They promised me they won't cash it until I completely moved in plus the 1st month's rent. I called three days after the deposit and said I changed my mind about moving in. I apologized and asked if it was ok. They said it was ok but didn't say anything about my SD. A month goes by & I noticed on the bank statement that it was cashed. I called her, no response, later learned they were on vacation. I left a note & returned address envelope. I stated in the note that if she doesn't return it to me that I'm taking her to court. She called back, blamed the problem on me, said she lost a month's rent, and said she had a right to cash the SD. She wanted a certain race/nationality for the room. She also wanted an apology from me even I already given to her. She yelled and intimidated me on the phone. Threatened me to take her to the police, to court, get a lawyer. Said I was too young to understand the SD law. Since there was no written agreement or anything signed, I believe I have a right to the SD returned OR take her to small claims court? I changed my mind b/c I found another place closer to college.
