T-Mobile Texas Recovery Fee and T-Mobile contract cancellation?

My husband and I have been T-Mobile customers for 8 years, however he is about to separate from the military and we're moving back home- which unfortunately does not have good T-Mobile reception. I'm aware of and willing to pay the Early Termination Fees, but here's my question. This morning I got this text message from T-Mobile:

"Texas Recovery Fee now included on monthly bill. Please visit [link here] for details."

In my service agreement, the contract states:

"Your Service is subject to our business policies, practices, and procedures, which we can change without notice. WE CAN CHANGE ANY TERMS IN THE AGREEMENT AT ANY TIME. YOU MAY CANCEL THE AFFECTED LINE OF SERVICE WITHOUT AN EARLY TERMINATION FEE (if applicable) IF: (A) WE CHANGE YOUR PRICING IN A MANNER THAT MATERIALLY INCREASES YOUR MONTHLY RECURRING CHARGE(S) (the amount you agreed to pay each month for voice, data and messaging, which does not include overage, pay-per-use or optional services (such as 411, or downloads), or taxes and fees);
(B) WE MATERIALLY DECREASE THE SERVICE ALLOTMENTS WE AGREED TO PROVIDE TO YOU FOR YOUR MONTHLY RECURRING CHARGE; OR (C) WE MATERIALLY CHANGE A TERM IN THESE T&Cs OTHER THAN PRICING IN A MANNER THAT IS MATERIALLY ADVERSE TO YOU. WE WILL PROVIDE YOU WITH AT LEAST 30 DAYS’ NOTICE OF ANY CHANGE WARRANTING CANCELLATION OF THE AFFECTED LINE OF SERVICE WITHOUT AN EARLY TERMINATION FEE (WHICH IS YOUR ONLY REMEDY), AND YOU MUST NOTIFY US WITHIN 14 DAYS AFTER YOU RECEIVE THE NOTICE, OR AS OTHERWISE PROVIDED IN THE NOTICE. IF YOU FAIL TO TERMINATE WITHIN THE RELEVANT TIMEFRAME, YOU ACCEPT THE CHANGES."

Does this new Texas Recovery Fee fall within these parameters? It is not a government mandated charge.


Thanks in advance. Either way, I have to cancel my contract so the end result won't change... but I would be lying if I pretended that not having to pay $400 would be nice. :)
 
It should as I dispute the same thing. This fee is not a tax, nor government mandated. This fee is tmobiles attempt to earn more profit by passing the cost of a tax that the state of tx imposes on them. They call it the texas recovery fee for a reason, because they wish to essentially pass this tax for their business onto their consumers. It is unlawful, and furthermore misleading because they add this to the section of your bill where the actual goverment mandated fees are outlined, to make you think this one is too. I just got the text on 3/2 myself, and they had already applied it to my feb. Bill, so much for disclosure. Call them, speak with a supervisor, to dispute this. They will submit it for you. Dont bow to this illegal activity.
 
"...or taxes and fees); " They are well within their rights to do this. The new Texas Recovery Fee is a fee. It is a cost imposed by T-Mobile to cover the tax put onto them by the state of Texas.

Needless to say, this falls well within the scope of their Service Agreement. Pay it or leave them.
