Frustrated Customer

I recently upgraded my phone (January) and got a Samsung Galaxy Vibrant 3G phone. They required me to sign up for a data plan which I choose an unlimited plan for $20. Like an idiot, I lost my phone while traveling to Miami this past week. I got a loaner phone but no longer need the data plan. I called t-mobile who told me tough luck, I'd have to pay the termination fee if I wanted to take data off my plan. How do I get out of this?
