Student loan tax return garnishment?

I while back TG was garnishing my wages. I made a payment arrangement with them and have been paying. Over the last year I have paid $2740. I had called me make sure that my tax return was not going to be garnished and they gave me the number to the IRS to double check! I made sure to check back on many occasions and was told there was no reason for my tax return to be garnished. They told me to wait until April to file just to be sure. Well my tax return was garnished!! I called and talked to the same guy I always talk to and he told me I should have filed sooner...when he was the one that told me to wait. And he told me since i waited that's why it was garnished. HE also told me that yes there was an error on their part but I did technically have a loan with TG so he would check with his supervisor and there was a 50% chance i may get it back! He pretty much said it was unlikely though. The tax return was for $4000 and I need it for my sons dental work and I am currently pregnant and need it for my doctors fee. I don't understand how they can do this when i have been paying and they admit it was done in error on their part? IS THERE ANYTHING I CAN DO!!
I had called FMS to make sure I wasnt flaged. I called up until April. What im being told by the people that hold my loan is that the government will sometimes re flag you if you wait to long to file. Is that even possable? Wouldnt the people holding my loan have to re flag me? And how could they do that if i have been paying them?
