still in AT&T contract, eilgible for upgrade?

My girlfriend's phone broke on march(Contract ends in Nov I think).
The AT&T gave her a gophone(different model) for a replacement.
And that new phone is weird. The phone sends txt msgs to other ppl and displays "insert sim card" when she makes a phone call.

And she wants to know if she can end her contract right now(without the penalty) and get a new model phone with new contract.

Can she do that??
what are some other way she can do so she can change her phone without paying any penalty??

She can, but not without penalty.

Either she'll be forced to pay an ETF of $175 or less or she'll be forced to get a new phone at FULL price...OUCH.

If she's been a customer for a while, they may give her an early upgrade...which she'll have to call them to discuss.
 
The upgrade kicks in with about 4 months left on the contract. So in August she should be eligible for upgrade. I would talk to them about an early upgrade since it's not that far off.
