sprint phone upgrade?

ok, so me, my dad and my brother are all due for upgrades. My brother and I get $75 off a phone and my dad get $150 off. i was wonder if my dad were to buy a phone with his upgrade offer, could he keep his old one and give me the new one? He likes his phone but mine is on the verge of breaking, so he said since he gets a larger discount, i could have his upgraded phone if it was possible.
also, if it is, please state your opinion (if you don't mind) of what the best phone for sprint is are the $250-300 price range please, because i was thinking about getting the sanyo incognito.

Your dad would have to get the new phone activated to his number first, and then it might be complimented to do over the phone but if you go back to the sprint store the next day have them activate his old phone back to his phone number and then activate his new phone to your phone number..
