SPRINT PHONE HELP PLEASE?

ok so my friend kari gave me her HTC EVO 4g for sprint, because she switched to at & t. and i have a sprint phone and i wanna switch from the phone i have now to the evo, but she said she is still paying the cancellation fee to sprint. Can i still activate this phone ? or does she have to pay the whole thing off first? im really confused with this please help!
