So how the fuck can you read the EULA inside without opening the shrink wrap?
Has anyone taken this to court? It seems ridiculous for you guys.
In the UK, its our right to take back ANY product (thats any bought physical product from a company) within 14 days of purchase if we arent satisified with it.
The receipt, either the front or the back, clearly states what the return policy is for any item. It is an assumed responsibility of the consumer to read the front or back of it before opening or consuming any item.
Stores refuse to give you the refund because they know alot of people will buy the cd/dvd/game, copy it then return it. The EULA has nothing to do with it.
Its got everything to do with the EULA. If someone doesnt agree with a game EULA, they shouldnt play the game.
But if you dont agree to the EULA in America (therefore you dont want the game you just opened), a retail shop can legally refuse to not give you a refund.
Doesnt anyone find that ridiculous?
Saying copying CDs is possible isnt a defense for this.
any competant manager will rebut with "The EULA says don't play the game, not return it. Our policy is to not accept any returns on opened items. What you do with it from that point is your responsibility."
It's BS but, you get the point.
The best way around this is to exchange the crappy game for an unopened copy of the same title (claiming manufacturing defect or incompatibility as the reason for exchange); then return unopened copy as per the stores policy.
I tried this with unopened DVD's and Best Buy basically told me to go to hell. I was given some DVD's that were unopened and they said no returns without a receipt.
Nope, my mother-in-law was going to throw about 40 DVD's out. At least 15 were still sealed so I was going to get in-store credit at Best Buy. I only took 2 to see what they would say and they said I needed a receipt.
Yeah, stores don't accept returns because you can copy the game. If you really, really, reallly, reallly, really want to fight it, you do have legal protection under the EULA, which cannot be read without undoing the game. But the hassle, and amount of retardation you're gonna have to fake just isn't worth it.
Just buy the local EB manager a 12 pack or something.
