She already is a judge. A bad one, and one who's opinions are frequently overturned by higher courts, but a judge nonetheless.
Should she become a Supreme Court Justice? To say that one would expect a "wise Latina woman" to make better decisions than a white man is both racist and sexist, and should on its own disqualify her.
Had a white male nominee said that white men should be expected to make better decisions than a Latina woman, there wouldn't even be a debate. His nomination would be dropped like a hot potato.
