Sending in a Flashed Xbox?

Ok i have flashed my xbox 360 a while ago and i want out.I hear if you send it in microsoft will send a new one to you.The guy who modded it can easily put that sticker thing that comes off when ripped because he send when I would get the rings of death just to bring it to him and then send it in.Will i get caught
