we purchased an expensive acreage just outside of calgary area 6 months ago, there is a bank mortgage on the property so we`ve been making the monthly mortgage payments. We just learned the seller has 2 previous caveats against this property and for whatever reason he does not want to prove he has had them removed. The agreement terms for this seller financing was we make the mortgage payments, the seller was to subsidize us for 6 months at which time we would owe him an additional $6k, and then proceed with making the mortgage payments until 2013, at which time we will then obtain our own mortgage...but now the seller is trying to gets us to pay that 6k now(the 6k isnt even due until the end of january) or he says he will have us evicted from the property, what can we do legally, as when we signed the contract we had no idea about the 2 caveats he had on the property.
