I bought a house in Jan 08 and we had a purchase agreement that by april 30 at the sellers expense he will install a chimney liner and install a washer/dryer. we got the house inspected the guy said that it needs to have a chimney liner in this township. well it still hasnt been installed so i got a few quotes from some plumbers and heating companys.
When they came to the house to give me my quote they told me that the seller didnt get a permit to put the furnace in and he didnt get it aproved by the city. the way that he put the furnace in is all wrong. they told me that if the city inspector came in he would tell me that the furnace should not be ran at all! Also that where the water heater is...its not aloud to be in the bathroom like it is.
I guess since he doesnt own the home he is not aloud to fix the problems himself and has to hire someone.
I know since he hasnt got this done that he's in breach of contract.my question is, is he responsible for all furnace repairs? can i sue him?
I have a sellers disclosure statement and it says the furnace works that he knows of. He didn’t live in the house he use to rent it out. Before we signed the final papers on the house he knew that the furnace had a problem (with the chimney). Does that count as him knowing there was a problem?
I’m not exactly sure what to do. I have a newborn and I don’t want to live in a house that isn’t safe. Any advise would be great. Thank you ?
