Restaurant overcharged my boyfriends credit card by like $63, don't want to refund it.

what should he do? My boyfriend went to a chinese restaurant as usual, 2 stores down from his job, to eat lunch. He noticed that they always charged a $1 more than what the total was. So he went and bought a soup with a drink with was about $7, only this time the lady charged him $70. And he didn't notice until he got home which was on a friday, so he said i'll deal with it on Monday because he didn't work on the weekend, and he didn't want to go back there. We'll Monday came and he went to complain and it turns out that they argued with him, being a regular customer, and told him that he was wrong and they wouldn't give him his money back. Of course he was frustrated after hearing this because he had been going there for a long time and he gets this kind of treatment. So he called the bank, the bank gave him the money and they went into detail about the overcharge. So today they send him a letter saying that they checked and couldn't find any fraud and that the restaurant was saying that there was no fraud. Now the bank is going to deduct the $70 from his account that they refunded to him. So what can he do to get that money back if it's even possible?
 
If your bf has to argue over this, it means he has not kept the receipt from the restaurant? The only proof of who is wrong is to go through the restaurant's own record of orders, but in order to do so, there has to be some legal authorization and this means your bf has to go through a lot of hassle, so he has to decide for $63 is it worth it. It's just like counting change every time before you leave the counter. Once you left without complaining, it's implied the change handed to you is correct.
