...riding my bicycle at night? I am re-posting this because well, I am new here and was surprised to see 3 responses so quickly after my initial post AND because my second responder had an interesting point I thought I would clarify....I have titled my question ".....while being intoxicated" BECAUSE it is my belief that THAT is what I will be ACCUSED of and not necessarily what really was....

I have ridden this route too many times to count over the years with not a problem. Recently work was done on the railroad crossing in my town, Several patches of cement were removed here and there from between the tracks where pedestrians and bicyclists would normally cross over smooth sailing. Returning from the local convenience store one night I went to ride across the tracks as usual to head back home and woot woot! Right into the gaping hole me and a boys bike went! I got up and walked the bike home. Been in ER 4 times, hospitalized twice for several days with severe hematoma to vah-jj, emergency surgical drainage for engorgement extreme pain suffering like unimaginable. I am deformed and in agony because at the crossing after the changes, no street lights were present, no warning blinking orange lights, no caution tape or safety cones, it was pitch black aside from distant store lights and occasional light traffic. I want to pursue a case against the town and/or the railroad for negligence. Lucky thing I didn't hit my head, pass out and get run over by the commuter rail or a cargo train. went to Er 1st time after walking home, it's been 3 weeks of torture. Here's the thing...I was questioned about how much I had to drink that night. No Breathalyzer, pee test or urine tests were taken to prove anything.
Please, no drunk bashing, I had five beers between 3 and 8, and nothing till about 10:30/11:00 when I was back home. Hell yeah who wouldn't need a hefty shot after that! While the ambulance was on its way I had time for two good ones cuz I wazza hurtan big time. So yeah they smelled liquor on me but truth is i didn't drink any liquor till after wards when I was home in my kitchen on the phone. No one can say I was sloppy, incoherent, abusive or rude.
Do I have a case? I say yes please forward your opinions.
