Really need help with this case study?

It was 5.30am on a winter’s morning and visibility was poor. As Pace swung into her driveway she was travelling at about 8 km/hr. In the course of turning through the gate posts she changed down to first gear and reduced her speed to 5 km/hr. She had gone about two metres when she felt a soft bump. She backed up and got out. In front of her was a woman, later identified as Moloney, dressed in dark clothes, lying lengthways on the driveway. Pace noticed a partly filled bottle of tequila besides Moloney’s body. Moloney suffered severe lower back injuries that resulted in her becoming a paraplegic and, therefore, unable to work as a nurse at a retirement home. She lost her husband as a result of the injuries.

I need to argue one side, as a lawyer?! whos at fault, what can i argue?!?! HELP ME!!!!!!!!
