allowed in war. Do you agree? Their are hadith where the prophet forbade killing woman and children...but some scholars say he forbade it not because they are non-combatants, but because its better to take them as slaves, as the prophet took the women and children of Banu Qurayza as slaves.
?Shayk-ul Islam Ibn Taymiyaah (Book: The Religious and Moral Doctrine On Jihad):
Some [jurists] are of the opinion that all of them may be killed, on the mere ground that they are unbelievers, but they make an exception for women and children since they constitute "property for Muslims".
??????????????????????????????????????
As for those who say we should re apply islam based geopolitics and the events of a specific time…and not listen to scholars of the past. My questions to them is “In the past the people took women as slaves? Now based on Geopolitcs, no one does this anymore, by their logic there is no use keeping woman and children alive these days… as you wont be taking them as slaves anyway, their main use is gone”
??????????????????????????????????????
According to the SUNNI hadith the prophet Muhammad (saw) allowed the killing of woman and children during nocturnal attacks (night raids) [Sahih Muslim 19:4321]
.
Its reported that in the Seige of taif the prophet Muhammad (saw) used Ballistics (catapults) against the enemy.
Sheikh Al Shuaybi says that the prophet muhammad therefore aknowledged that non combatants may be killed and allowed indiscriminate killings.
??????????????????????????????????????
Al-Ghazali said in his book "Kitab al-wagiz fi fiqh madhab al-Imam al-Safi'i":
"One must go on jihad (i.e., warlike razzias or raids) at least once a year...One may use a catapult against them (non-Muslims) when they are in a fortress, even if among them are women and children.. One may set fire to them and/or drown them...If a person of the ahl al-kitab [People of the Book] is enslaved, his marriage is [automatically] revoked...One may cut down their trees "
…….The prophet reportedly cut down the trees of the Banu Nadir (it seems some muslims are confused about cutting trees, the lotus tree is the exception)
