Questions about selling an AT&T phone

My brother gave me his old LG CU500 to sell on ebay. I have a few questions.

1.) Does the SIMM card go with the phone?
2.) It was shut off for non payment. Can a buyer get it turned on?

Basically I don't want to brick anyone. Hopefully someone can help me out with this. I'd really appreciate it. Thanks
 
A new owner would require a new SIM card. He would get that from the carrier or buy an unactivated SIM card elsewhere. An new SIM card would make the phone work as before but with a new account and phone number.
 
The buyer will need to get themselves a new 3G Sim for that device. I know you didn't ask, but you will not be able to get the device unlocked through at&t, nor will the buyer. The IMEI is going to appear on your brother's NPD account. The device has not been fully paid for, nor has he completed his contract.
