Question related to Optus iPhone (to do with insurance and unlocking)?

Hi,

I had an iPhone #g which went missing, and I have recently made an insurance claim, as my phone was covered for loss. The claim is being processed and I'm pretty confident the outcome will be positive. Also, I am currently in a position to recontract my plan, and I can choose a new phone. I want to know if I can recontract, get the iPhone 3G-s, and sell my new iPhone 3G which I got back from my insurance claim. This would mean I am locked in to Optus for another 24 months, which is ok with me, I get the new iPhone, and I make some money by selling my insurance aquired iPhone, though minus $250 excess.
I guess I have a few questions,
1. Is this legal
2. Can the iPhone be unlocked from Optus, and can I sell it to anyone (possibly on eBay)
3. If this is possible and legal, how much should I sell it for (in $AU)
Sorry, #G is meant to be 3G.
