Question about withholding 2009 tax return for nonpayment of child support...?

I got a child support order in September of last year and it's now May and I haven't recieved one payment. My ex said that he filed taxes so that I could get all of his refund. My question is will I only get payment for the 4 months of 2009 or will it include the payments from 2010 as well? Assuming he has that much of a refund
