Question about the esn of the Motorola Droid?

okay just recently i bought a motorola droid off of craigslist, dumb me forgot to check the esn before buying it and when i called verizon they said it was still attached to an account. I contacted the guy and he told me to give him an hour and he would have it taken off. he also said that his number would change once he did so and he would text me on that new number and say "its ready" so and hour goes by and he doesnt call or text me. so i call verizon back and the esn still hasnt been taken off. It hasnt been reported stolen or anything so i dont think the guy sold me a stolen phone, but i dont know what to do with it. should i wait it out and hope they eventually either take the esn off the line or just cancell the line completely? please hellpppp
