Question about laws/permissibility RE: recording conversations?

Does anyone know the laws regarding recording a conversation you are having with someone who is unaware they are being recorded?
Can it be used as evidence in court? Is the act itself illegal?

Please state your source if possible as you are settling a bet.

Your help is much appreciated!
 
The law varies by State, but "in general" it is legal to use a recording of someone made without their knowledge if they do not have a "reasonable expectation of privacy".

So if you are sitting alone with someone at home and you record them without their knowledge then in most places it will be inadmissible. If you're sitting in a restaurant with people walking by, it probably is.

I live in NC and It's ok to record as long as one person knows that the conversation is being taped. You cannot record two people without their knowing. I have researched this. You can google NC and the recorded phone laws and it will tell you the same thing. Some states are like NC others don't allow recording at all. Sorry I edited this because of spelling
