Protection plan?

If you have insurance on your line then you switch to a phone bought off the internet then you should be ok.

It really depends on the company, and I cant speak for TMO, but with Sprint-Nextel doesnt matter where you got the phone, as long as you already have insurance on your line then you are good to go. If you dont have insurance and want to add it with sprint-Nextel you cannot if it more than 30 days of activation, and I mean new activation, not swapping phones.
 
Well, wife bought me a new 8700g off ebay last month. Activated (from a treo 650 with VPN internet) and was offered the $6 Equipment Protection plan.

Later, I called both T-mo and the insurance company (can't remember which company) and both assured that as long as the phone is new and never been activated, I am covered (well, with $110 deduction). The lady from the insurance company even told me to keep the box with the barcode, in case they need some kind of verification.

~via BB (wap.rabroad.com)~you should be ok. The intent of the plan is to cover the equipment that you use. It doesn't matter how you accompany it, as long as its not reported stolen you'll be ok.

The equipment protection program will cover you if you get it within 14 days of the START of the use of the equipment. At T-Mobile we use a 3rd party company to do insurance called Asurion and they have the 14 day policy. The warranty is void if you buy it off ebay but you can still get insurance
 
but if you bought off ebay and the model is still less than 1 year, you can still make warranty claims through RIM, although they will only cover equipment defect repair costs and not costs associated with that (such as shipping or handling fees).

Warranties will not cover accidental damage either.
