generally, the argument is under the 14th amendment; equal protection and due process (guarantee of a fundamental right to marriage).
 
I was on the trolley in San Diego coming home from class and these two black ladies were talking about voting YES on 8 because "its nasty" and shit, I had to hold back informing that in 60 years ago they would not have even been allowed to be on the freaking trolley.
 
It's argued in federal court right now. There's no guaranteeing the supreme court will hear the case either.
 
How is it any different from the legislature enacting it? How difficult would it be to elect representatives sensitive to the gay marriage issue; so much so that they would pass an amendment recognizing it?
