Problem with Headset in Xbox Live?

I recently purchased a brand new Powerwave xbox 360 headset so I could communicate with my friends on Xbox Live. I plug the cord into the bottom of my wireless controller, turn the volume on the headset on max, turn the headset on and also checked my voice settings. The volume is set to 10, the microphone isn't muted, and the voice output is set to Play Through Headset. I also DO NOT have a child profile so no restrictions there. Everything seems all set, until I launch Halo 3.... Now I know in-game you pres up on the D-pad to talk, but that's not the case with mine. I press up, and then say some words, but there is still no broadcasting icon near the bottom right hand corner of the screen. And the funny thing is that I can see that satellite looking symbol thing, but it never enlarges and flashes when I start talking. Although it does flash when i either plug or unplug the headset for like 2 seconds. I have also tried recording a message and then playing it back again, but there is no sound.
On a side note, I made sure the headset is compatible with the xbox 360, as it also says that on the box.
