Privacy issues with using one of these things

I'm pretty well sold on the Nokia N9 at this point - it looks like it's going to be a little chunky but I love how Nokia is committing themselves to openness. That said, this'd be my first proper cell phone and I've heard a lot of scary things about reprehensible behaviors of the companies involved. Apparently Google and Apple both track your movements via the GPS in your phone. Assuming that Nokia decides to do this as well, is this something that I'd be able to turn off?

Alternatively, I saw the bit about the Clear mobile hotspot: I live in NYC, so I expect that coverage will be ok. What if I bought the Nokia but didn't sign up for service? Then I could get some VoIP service and connect over WiFi through the Clear device. This would be untrackable assuming that the Clear doesn't have GPS. Are there any downsides to this (other than carrying around an extra thing)?

Any other pointers/tips? I've avoided buying a cell phone all this time because of the way that the providers have been treating their customers, but the N9 looks to be bucking this trend and I want in on it (if possible).
