Prison Law - Mobile Phones?

If an inmate receives a 'nicking' (e.g for a mobile phone) whilst in prison, but he doesn't get a 'nicking sheet' within 48 hours of the incident occuring, is the charge likely to be dropped at an adjudication?
I'm asking this on behalf of my partner.
