I am asking this question for a friend.
My friend recently got pulled over(Mid-October) and was charged with Driving with a Suspended License (Maryland). They were not arrested, but they were given a trial date of early December. They were unable to get a public defender in time, they put it off for a bit (bad idea), and by the time they called the office to get a public defender the deadline was past.
The office told them to go to Court and ask for a postponement of their trial date. The way that they understood it was that they need to show up for their original court date, and when called up ask the judge for a postponement of the trial. If this is the correct way, which is the best way to ask the judge for a postponement? Just to say "can I please have a postponement" or is there another way.
The way I was told, is that you write a letter to the court asking for a postponement, and do NOT show up in court on your scheduled day.
Which is correct? The trial is in less than a week and we are trying to figure out which is the best way to approach this.
Any in-depth asnswers are greatly appreciated. Also, what is the likely punishment for this offense? The persons record is fairly good, the only reason the license was suspended in the first place in because they missed a court date for a traffic violation. Please do not scold on us taking this seriously, we know. I'm just trying to help them dig out of this hole they're in.
