Possession of Marijuana on a Bicycle in Delaware?

My boyfriend was recently stopped while riding his bike late at night riding back to his apartment from mine to get his school books. They stopped him because he didn't have a headlamp on his bike, searched him, and found about 4 grams of Marijuana. The cop wrote him two tickets, one for the headlamp and one for the possession. This is his first offense. He is supposed to be moving from DE to live with me and my mom in PA this week so we can help her through chemotherapy. My question is, how serious of a punishment will he receive if he is convicted, and what are the odds of the charges getting dismissed? Also, would he still be able to come with me to PA if he is put on probation? He can't afford a lawyer, so he's going to have to go with a public defender. It was not in separate bags, and he was not going to sell it. It was in his pocket.
