The credibility of the statement can be challenged, but it will not be thrown out. The jury determines credibility, not the court.

thrown out if it whent to court? If you wrote in your report that someone was POSSIBLY stopping people to go into a store. can you take legal action. like banning them from that area for a certain matter of time. I have court and in the security's statement it says i was possibly stopping people from entering a restaurant. when i was waiting for my son to go on his break. they also said, i was loitering and i was only there for 11 minutes. they have tapes of this which only shows me sitting there talking to my daughter. i did say hi to one customer i know. that was the only one i talked to. I just want to know how i can have this thrown out on that one word.(possibly). thanks.
