Not to worry dude- you can't get the third strike from a civil matter, only from a felony in a criminal matter. He's suing you in civil court. If he gets a judgment, just file for bankruptcy.

Before I start, I'd like you to note that I make almost enough money to keep myself alive. I can't afford a lawyer.
Also, if I loose, it is my third strike (3-Strike state), all bullshit.
Strike one:
My POV: I had a couple beers, was getting ready to head to bed. I realized I left my cellphone in the car. I went out of my apartment to the car, picked up my cellphone, then was thrown down by cops from nowhere, arrested, thrown in jail and then sent to court.
The two cop's story:
I was speeding down the road after hot-wiring my car and assaulting an old lady. After speeding away from the cops, I pulled into a random parking lot, exited the car, attacked the cops with the knife right before they heroically took me down.
The attempted charges were:
DUI, 32 traffic violations, Grand Theft Auto, Felony Assault (WTF?), Sexual Assault (WTF?), Assault with a Deadly Weapon, Battery, Assaulting a Police Officer, Attempted Robbery (WTF?).
After the old lady didn't show up, the car I stole was strangely mine, I did not hot wire it, the weapon I apparently used to try and kill the cops mysteriously disappeared and the cops had a peculiar lack of bruises, was given a nice sentence of only: DUI, Public Drunkenness, Battery.
Since that day, I have always looked at muggers and thieves as successful traffic cops.
Second strike was when I was exiting the grocery store after buying food, not paying attention to where I was walking. I kicked somebody's slim jim on accident to the magnetic detectors.
The security guard (Yes, mart cop) decided I was trying to steal the food and kicked me as hard as he could. While I was tripping over the stool he kicked me towards, one of my shoes flew off and hit him in the cheek, leaving a "Brutal Wound" (Barely-visible scratch).
I was charged with Battery and Assault.
Two weeks ago, I was walking to work. I waited at the red light.
I go to work at about 3:00 am, so the streets were empty.
I waited anyway, the little walk sign lit up.
As I was walking, some jerkoff in a mercedes sped around the corner with his girlfriend, ran the red light, saw me and tried to stop.
They hit me, but the car didn't hurt me bad. I got some cuts and bruises, but nothing major. However, my I.D did fall out of my pocket.
I said "I'm O.K", but he ignored me, picked up my I.D, looked at it, wrote something down, threw it back and said "Free money, bitch".
So, next week I got my court papers and I went this morning.
The hearing is tomorrow-
The guy is trying to sue me for $5,000 in property damage AND have me charged with reckless endangerment AND Battery again.
Oh yeah, apparently I also punched him in the jaw.
I will go to prison for this shit if I don't win.
What should I do? I will go to prison for tax evasion or something if I get in any more debt.
