Panasonic Lumix tZ7. I dont know what to do. I need help!?

I bought the Panasonic Lumix TZ7 in red on ebay just under a week ago. And received it on friday. But it was stated brand new. And when i received it. I just opened the box and noticed a lot of tiny scratches on the screen and a tiny scratch on the red paintwork. I'm not sure whether to open a dispute and get a refund as the seller is not returning my messages. Or just deal with the scratches. And there is a problem with the warranty. As i bought if off ebay. I have no receipt. so no warranty. Any advice would be much appreciated.

I would say open a dispute/claim. If the description states its new, then it should be new. You received something that is obviously not new then it is not as described. They should have stated any flaws on the description and showed actual photos of the item.

If you pay with Paypal it should be covered. Read the seller's return policy. Most would say sale is final, no returns AS IS etc. But if they did not disclose the defects, it could be considered fraud. Return the item with tracking info with insurance, document the flaws of the camera, take photos etc.
Most of the time Paypal is on your side, there is a saying, "Customer is always right".
