Hello There. I am looking for some insight because my family is insisting that I file a claim. I live in California and am an Outside Sales Rep for a brokerage in the grocery industry. My whole job takes place in my car as I drive from store to store for a living. My boss signed me up to do a reset at a store where we help move the shelves around and stock them. I was not dismissed from my regular duties however. In Ca there is no overtime or labor laws protecting Outside Sales people.
I worked from 8am until 4am the next morning due to the reset. It was a long distance from my home (about an hour drive) and it was pouring rain. On my way home I was in a terrible car accident and knocked unconscious. I hit a guard rail and am not sure whether I fell asleep or just lost control. I have no recollection. This was in January and my boss was the first person I called when I came to in the hospital. Thousands in bills later, I am feeling angry that they feel no responsibillity and said it was on my time/not thier problem. Can anyone familiar with Workers Rights and Workers Compensation tell me if this is true or should there have been a claim filed?
