our dogs keep getting into next doors garden who is responsible for the fence?

We have 2 dogs, both staffordshire bull terriers. They keep getting into next doors garden. The fence is old and rotten, the main cause of them going in is there grandchildren calling the puppy who loves children. They dont escape on the other side as the fence is sturdy but we are having problems as he says we should keep our dogs in but we cant when his fence is old and his grandkids are winding the dog up! Can anyone help??
If i see his grandchildren in the garden I call the dogs in and keep them in. Ive spoken to my neighbour on the other side and he said as we are in a council property each person is responsible for the boundary fence to there left. its the neighbours left, our left fence is fine. He says he will go halves but i think he should pay for it as its his problem not mine!!
They are really soft dogs, good as gold with children, but I understand were you are coming from with regards the DDA. This neighbour is a constant complainer, he moaned about our cat going in his garden 2!! and my daughters tv being to loud!
I guess I will have 2 keep my dogs in unless im watching them, as i refuse to get the fence done when its his fence!!
My dogs are not pit bulls they are staffs!! But anyway they are not nasty dogs. They are great with my babies who are 4 and 2, but You can never trust any dog 100%. We will build something in time, its costly, and with limited income isnt possible at the moment. As ive said i will just watch them when they are in the garden, we have made a makeshift fence with old stairgates and doors but his grand kids keep knocking them down!! I no its not the dog as its knocked away from the dog and nails have been pushed out which the dog cant do! also when the children are not in the garden the dogs dont escape!!

He rang the council out today who said they will put a small wire fence up but he said theres no point in that as the dogs will jump it. But when i rang the council they said it was his responsibility!! The posts are on his side.
Its prinicple, they are only getting into his garden when his grandkids push the fence over and call them. therefore his family are causing the prob. I only let them out the back when i can see them and supervise them, they dont get into the garden we are also next 2, or in2 the street, or into the gardens we back onto only into his!! so therefore he should sort his fence. i will continue 2 ensure they dont get into his garden but I refuse to replace the fence!!
Cats Eye, ure answer is the best :) I will speak to my partner and ask him to sort that for me, until we build a fence within our garden. I refuse 2 get his fence paid for :)
