Nexus S please help!?

I bought a used Nexus S for sprint, when I called to activate it, they said it was still in service with the person I bought it from.It doesn't have a bad esn, its not stolen, its just still in service, but its disconnected. The person I bought it from forgot to deactivate her contract, she didn't pay her bill.if I get the person on the phone from who I bought it from, and me and sprint customer service in a conference call, will they activate it? If not, is there anything else I can do besides get refund, can I wait a couple of months? Please help!!
