In New Zealand, if you are married and extremely unhappy, with one school age child and one infant... can a father file for sole custody while living with his wife?
Currently his wife has scratch marks on her wrist from trying to commit suicide (halfheartedly) and has screamed "I'm going to die" in front of her children. the police were called on domestic disturbance, they will not place her in the hospital but send a Respite Nurse to the house.
This woman has a habit of controlling people, driving others away, making the husband secluded with no friends of his own. She has stalked him and spied on him. She is the one who committed an affair years ago and was caught in the act.
she is screaming and throwing fits everyday because he wants a separation. He has gone to marriage counseling with her, and he has made attempts to talk with her and with counselors to try to save his marriage. She slowly drove love for her completely out of his heart and he now wants a separation.
Then all of this happened and now he is stuck in the house, with two children and an unstable wife.

CAN HE FILE FOR FULL SOLE CUSTODY OF HIS KIDS WHILE LIVING WITH HIS WIFE THAT IS ACTING LIKE THIS?
