A paramedic is asked to attend the home of an asthma sufferer. Instead of going straight to the patient she stops to buy a lottery ticket, meanwhile the patients condition worsens to a life threatening state. Upon arrival the paramedic panics, drops the patient and causes a broken hip.
I've estalished that the paramedic would be liable for anything that results from the worsening of the asthma condition due to the fact that she took the detour out of her line of work. However, in her duty she dropped the patient...so who is liable the paramedic or the employer under vicarious liability? or would the fact that she panicked due to her own lateness (out of employers hands) and drpped the patient mean that she is liable for everything?
