I received a summons from Capital One but the Plaintiff is Solomon and Solomon P.C from Albany NY. The debt is for $2680 and the court date is in 2 months(End of April). Now i called Solomon Firm to try to settle they said they could only go as low as $2180 i tried for $1500. The thing is should i try to settle with these people or just go to court because i just got unemployed and i have the papers to prove it and try to get declared judgment proof and i have no assets expect an older SUV? I do have some money in my savings but i need that now since I'm laid off or would it help me if i visited a lawyer and have that lawyer contact Solomon on my behalf to get a settlement for maybe even lower than what i originally offered? Maybe they will see that I'm serious. My credit is bad now cause of my actions but I'm more concern of the lawsuit and getting it settled out of court or going to court and not getting a judgment. Any advice from someone with some legal experience would great. Serious answers please........
If i let the summons go unanswered how long will it take for them to garnish my paychecks or garnish my bank account? I live in MA. but the collector is out of NY. If they garnish anything i can still make a payment deal or do i have to now pay more money to them than the original debt of $2680? Thanks
