need a new phone without 2 year contract renewal?

my phone was water damagedand they couldnt repair it so i got the cheap $40 phone... but im hoping to get a new phone.. i have at&t... the nice phones are too expensive without the 2 year contract renewal but i cant get htat because my contract isnt up... what is the best thing for me to do..should i buy a refurbished phone and if so.. where?
