My previous employers are doing some illegal and immoral things. i want to know if i have grounds to go to the labor board in NC or not. Please only people with actual knowledge, and do not be rude.
-I worked (past tense) for a privately owned company. The two owners were a married couple. The manager of this store (there were 5 employees total) happened to be a previuos coworker from another job. Upon being hired, we both explained to mgmt that we knew eachother outside of work, and that we have hung out before. They said "no problem." so i was hired and began. Around 3 months later, my owner pulls me aside to accuse me of sleeping with this manager. he claimed that he had complaints that we were seen/talked about sleeping together. While this can be a valid question, my manager was blatently homosexual, we told the mgmt that he was gay, and they even met his live-in boyfriend. But still, it continued.
A position opened up that i had earned, and applied for it. I was turned down (not even told when interviews were) because he still assumed we were "sleeping together." That is only one thing.
2. We were told to do illegal things with our cash registers/labor laws. During an 8 or 9 hour shift, we were told NOT to leave the store/take a break for food or restroom. Restroom was to be ran to and back and only in absolute emergency. Food, if consumed, had to be brought because we were unable to leave the store for any form of a break. (we werent allowed to eat at the store, how could we bring food?) and also, they made us return credit card returns / refunds in cash only, so they did not have to pay the credit card fees.
3. When we started, we were told that our salary was 7.00 per hour + commission. These owners would revoke commission at whim, for however long they felt like. Even if you did nothing wrong, but the store did, your commission was gone.
My final complaint was about overtime. IF you hit overtime, the money came out of your commission, not the company. They refused to pay overtime in many cases.
Do i have grounds to go to the labor board. I have proof of the 2 incidents (no breaks and credit cards) and i have my manager who can speak about the accusations, but as for anything else, any ideas? i truly need to have the labor board investigate this company because of the sketchy stuff they have started.
