liability settlement? My 7 year old son's arm was burned when his napkin caught fire reaching for a cinnamon roll at Home Town Buffet. The napkin was siting on top of his plate and brushed a heat bulb and instantly caught fire. The hostess rushed and patted it out with her towel, but his arm was burned. Not major burns but enough to be burned. Shortly after wards, the hostess approached the table and displayed scars from her own previous burns and asked that I please file a complaint. So that maybe something could be done about it. Because no one responds to employee complaints about the problem. My son has been very upset by the incident. I have spoken with the Corporate office and the insurance company. Does my son have the right to be compensated for his experience? I am a nurse and because the burns were not 2nd or 3rd degree I elected to treat it myself at home. As long as no infection presents itself I don't feel the need for unnecessary medical bills that may not get paid.
It would seem that my son being traumatized and, in pain for the last few days with a bandage on him arm in the very least would constitute pain and suffering. On a different note, if management has been aware of the hazard the numerous complaint by there own employees and yet still elected not to correct the danger, that would also constitute "gross neglect" would it not?
And of course my child was accompanied by and adult. He was on one side of the counter and I the other. The server was the one who put out the fire because she had a towel in her hand.
Lastly, (I think...LOL)

An insurance adjuster called me at the contact number listed on the accident report. And said he would be in touch with me regarding the incident to settle the matter as quickly as possible. I am just curious. Is the insurance company calling me to offer a settlement to my son?
