My PS3 headset won't work.?

My son got a PS3 Bluetooth headset a few days ago. It's turned on and fully charged but the when he tries to use it while playing Resident Evil 5 online, using his PlayStation 3, the other players cant hear him at all. We tried pressing the mic mute button on and off but the red indicator light doesn't come on at all.Is it supposed to light up when the mute button is pressed? Is the headset broken or is there something else we need to do?
 
I've got the same problem. I'm pretty sure there is no voice-chat/voice-communication on RE5, because no one can hear me on Resident Evil 5, but everyone can hear me on Call of Duty 4: Modern Warfare. I hope I helped.

P.S.: I recommend getting a refund if it doesn't work on other games, and not just Resident Evil 5.
