My daughter in law, had a expedited removal from the US for using a false

passport.How can she get back to US.? My daughter in law went to Mexico the get a permanent Visa. She didn't want to spend months away from my son (US citizen) so she used a passport that she got using a false name. She was caught. She was not tried by immigration but she was charged with the misdemeanor of unlawful entry by alien. After serving a short sentence, she had an "expedited removal" by the immigration and customs office at the charlotte international airport. Is there any US/Immigration official that we can speak to that would help her gain legal entry to the US?
 
With the way things are right now in regards to immigration, that was a pretty dumb thing to do.
She will be lucky if she gets back in this decade.
 
There is a way if the husband can prove that if she can not come here there will be a hardship for the husband..not the financial hardship but some kind of helth probelm, us born child, childs health and have to prove that it will really be hard for the husband and it will be even harder for the husband to move to mexico. The expedited removal alone would cause enough problems in itself, however the use of forged documents on top of it is the final nail in the coffin. Unfortunately, there is no statutory remedy for your daughter-in-law to become legal in this country for at least the next five years and probably more depending on exactly what Immigration did. Unless there is some major change in the laws as they stand now, there is very little, if anything at all, you can do.

Immigration and Nationality Act Sec. 212 outlines all the ways a person can be ineligible for a visa. Both prior deportation (expedited removal) and the use of fraudulent documents is on there.
 
was she born in the U.S? if so, she is a U.S Citizen and should contact the US Embassy in Mexico

You shouldnt mess around with imigration, she might have to just sneak over through the dessert like other mexican imigrants do...
 
Angrey? Your daughter was charged with a Misdemeanor, and with that in paw, I believe she can get back in in ten years.
 
she cant. she frauded the immigration service too get into the country. why would they let her back in after that?
 
She won't get back into America after she forged a legal document. She ruined her chances and should have done this the correct way or easy way by applying for one or marrying a citizen.
 
well in order to do that you need to talk to the judge
and immigration and also your daughter has to pay the consequences

Nope - that is what happens when people break the law...............if your son wants to keep her company - he should move to Mexico.
 
We don't need people here who are going to break the law. She used a forged document. Perhaps your son can move to Mexico and enjoy life in a country that seems less concerned about the law than we do here.

It was rather silly to choose to re- enter deceptively. What grounds can she offer the Us /immigration official to consider her application for Legality?
Perhaps there is a clause that allows her to reapply, after a specific Time lapse for immigration status again.
 
No, she should stay in Mexico, she violated the law and she have to pay for that, luckily she is when she is not in jail and then get deported.
