My cousin has told me that: (assuming I am innocent of any crime) Never agree to be interviewed by the police without a lawyer present. Speak to the police as little as humanly possible. Always reserve your right to remain silent. Talking to the police can never benefit you even if you are completly innocent. You are innocent untill proven guilty. you are not abliged to help the police in any way. If you witness a crime and you want to help, still do not agree to be interveiwed by the police without a lawyer present. You would be suprised how quickly you can go from being a witness, to being a suspect. Sometimes innocent ppl go to jail. If you are not being detained or arrested, you are free to go. Even if you know you are not in possession of anything illegal, never, ever let the police search your purse, car or house without a warrant. The police will tell you that 'if you have nothing to hide, why not let us search?' Respectfully and politely decline and do not let yourself be verbally bullied. If they search your possessions illegally, tell them you do not conscent to it, that you will not answer any questions, and that you will be contacting a lawyer. If they really had a good reason for a search, the would have a warrant or they could get one. Things you say can and will be used against you because things can be missunderstood, taken out of context, etc. Also you may be in possession of things you didnt even know were illegal or inadvertently say something that can be bad for you if you ever make it into a court of law
What do you think: good advice? He didnt really explain and I dont see him often... can someone elaborate in this advice? BTW i live in canada and the laws are very similar to those of the states.
