My car has damage do I fix it before surrendering it??

Im in the process of filing bankruptcy and I got into an accident that was not my fault. The other insurance company is taking for ever to make a decision because there is no police report. I need to turn in the car as the payments have not been paid last month or this and I dont want them to come get. Do I wait and get it fixed or does it make no difference?? I dont want to call the bank and ask because im sure they will come and get it before I take it in??? Does that matter???
 
get it fixed or take the money to get it fixed. for down payments are hard to come by.
