i was turning right on a one way parking lot when i saw the other car's reverse light on, i used my horn to warn the driver but the car still backed up so the other car hit me on the front right fender i tried to back up but it was too late and my car has damage but the other car does not have. the other driver kept on saying it's my fault because he said that i should have seen him backing up. i also want to know how will the insurance company determine who's at fault? there's no witness and all. can they see the video camera of the parking lot or something?
my car has damage and the other does not have damage. who's at fault?
